This contract becomes valid in two cases: a) From the CLIENT/USER’s order on our website, without involving an internal salesperson from SPOSATO.
b) If the order is made by a SPOSATO salesperson, the contract becomes valid upon the first payment made by the CLIENT/USER, acknowledging receipt of the email containing the terms of use and contract.
By making the payment, the CLIENT/USER agrees to the following items: a) By making the payment, the CLIENT/USER agrees that they had the opportunity to read this contract beforehand, which was sent to them both via email and WhatsApp.
b) The CLIENT/USER agrees that this contract applies to all services offered by SPOSATO, but what specifically validates the contract is the detailed order sent to their email, containing exactly what was contracted.
1. Object This platform aims to be an “e-commerce,” i.e., to offer the sale of products and services online available on our platform or app. This document was created by attorney Diego Castro and modified with permission for this website.
2. Product Reservation 2.1 Our website does not offer the possibility of reserving any of the products available on our platform.
2.2 The fact that a product/service is in the shopping cart does not constitute a reservation and does not prevent other people from purchasing the product, which may become unavailable.
3. Client’s Obligations 3.1 The client must provide complete and correct information when registering on our platform.
3.2 The client is responsible for any errors in writing or the incorrect transmission of data.
3.3 To make any purchase on our website or add products to the cart, it is necessary to log in with the username and password provided during registration.
3.4 The client should not share their login information with third parties, under penalty of being held responsible for any actions resulting from such use.
3.5 Each client can only create one account; multiple accounts per CPF will not be accepted.
3.6 Use the platform while respecting ethics, good practices, laws, and regulations in force in the country, under penalty of facing sanctions.
3.7 The client must be of legal age (18 years) and fully capable of registering and making purchases on our platform.
3.7.1 If a minor or a person without full capacity makes a purchase or acquires any product or service offered on our platform, it will be understood that the responsible parties have authorized the purchase and will be held accountable for any situation that arises, as well as for the purchase itself.
3.8 Do not post or send images in reviews that may conflict with ethics and respect, or that are defamatory, offensive, hateful, or discriminatory.
3.9 The first login access will be made through a link sent to the registered email.
3.10 Do not provide any false, fraudulent, or incorrect information that does not correspond to your data.
4. Obligations of the E-commerce Owner
4.1 To clearly and truthfully inform about the characteristics and specifications of the product available for sale, in a clear and complete manner. (e.g., colors, height, material, or width).
4.2 To send the products/services within the established deadline.
4.3 To provide a secure platform.
4.4 To provide images, audios, and videos about the products offered, which accurately reflect what will be delivered to the client.
4.5 To issue the invoice for the product/service that will be sent and send it to the client along with the product.
4.6 To inform how the product should be handled, cleaned, or washed, and any other relevant information related to the product.
4.7 To conduct meetings within the defined deadlines and deliver the projects to the users/clients within the deadlines defined for each product.

Information about the Plans
The descriptions of the plans refer to a set of services for each of the contracted environments.
Each contracted environment must be less than 20m² for residential environments and less than 50m² for commercial environments.
The number of meetings for each plan is not cumulative based on the number of environments. That is, regardless of the number of environments contracted, there will be one revision meeting for the Express plan and two revision meetings for the Compact and Premium plans.
5. Disclaimer
5.1 We are not responsible for the misuse or incorrect handling of the product, nor for any damage that may occur during the installation of any product/service purchased on our platform.
5.2 All products/services we sell are within the standards and conditions provided by the manufacturer, distributor, or the company that resold the product.
5.3 We are not responsible for the execution of services contracted by other companies, which are the sole responsibility of the Client/User.
It is the responsibility of the client/user to provide the measurements of their environment.
Even when SPOSATO performs the measurements for the project, we will not be responsible for measurement errors during project execution. Each supplier executing the project must confirm the measurements.
5.4 The projects developed by SPOSATO Premium are all executed online, so we are not responsible for the execution of any material or project at the client’s house. All measurements and the project must be verified by the supplier executing the product. The responsibility for installation and execution lies with the suppliers contracted after the SPOSATO project.
SPOSATO Premium does not perform technical signatures, electrical, hydraulic, lighting, or architectural construction projects. If the client requires these services, we recommend hiring a suitable professional from the location of the property.
As described in the items, in the Compact plan, we provide positions according to the decoration and arrangement of furniture in the environment.
Some items for which we are not responsible:

II – Installation of stoves, hoods, lighting, or household appliances
III – Water and sewage pipes
IV – Kitchen or bathroom sink siphons
V – Masonry or installation of glass, stone, marble, granite repairs, or similar items
VI – Installation of tracks, rods, blinds, chandeliers, paintings, and other decorative items
VII – TV mounts for home theater
VIII – Chair, table, and sofa protectors (felt)
IX – Confirmation of measurements on-site for the execution of furniture, stone, decorative items, and similar
X – Project monitoring
XI – Sale of furniture or any product included in the project
XII – Execution of furniture installation, drywall, flooring, painting, or any item that is beyond the project scope
6. Intellectual Property
6.1 All design and layout are the property of our website and were developed by a service provider hired for this purpose.
6.2 All images, illustrations, artworks, HTML, trade names, software, or videos provided on our platform by one of the page managers are our property.
6.2.1 The images and videos are purely illustrative, as colors or tones may vary depending on the monitor or device screen.
6.3 The logo, brand, and overall appearance of the web company/website are our property.
6.4 Copying any image, video, design, audio, appearance, or product descriptions from our website without authorization is prohibited, and violators will be subject to penalties.
6.5 We are not responsible for external links that may appear on our website.
6.5.1 Some areas may display advertisements or external links, but we have no relation to them. Be cautious when navigating these pages and providing your data, as navigating these pages is the responsibility of the user/client.
6.6 Nothing contained on our website grants the right to a license or usage rights without the explicit consent of one of the page managers or the website owner.
6.7 Consent for copying or sharing must be given in writing, clearly and explicitly.

7. Payment Methods
7.1 Accepted payment methods on our e-commerce platform are credit card, debit card, TED, or PIX.
7.3 The product will be shipped once the payment is processed, recorded, and confirmed on our platform.
7.3.1 The service will begin development as soon as the payment is processed and recognized by our platform.
7.4 Any other form of payment is not accepted on our e-commerce platform.
7.5 Discount coupons are accepted, provided they have been made available by us and are subject to depletion or cancellation at any time.
7.5 If the client wishes to split the payment into more installments, they will be responsible for the interest charged by the operator, if applicable.
7.6 To request a refund, please contact our Customer Service (SAC).
8. Product Delivery and Shipping
8.1 The product will be shipped as soon as the payment is confirmed, and it may be shipped up to 3 days after payment confirmation.
8.1.2 In the case of projects, the project will be developed within the time frame related to each chosen package.
8.2 The shipping and delivery costs will be displayed when you are about to finalize the purchase, in the shipping/delivery section, where you will provide your address and postal code.
8.3 The customer will pay for delivery and shipping based on predefined price ranges, or according to the standard weight of the category.
8.4 In case of contracting services / Sposato Project:
All services will be delivered in PDF format to the customer’s email and WhatsApp contact.
Meetings between the CLIENT and SPOSATO will be prioritized in an online format. If the CLIENT desires in-person service, they must inform SPOSATO and check both feasibility and availability.
9. Exchange, Return, and Cancellation
9.1 The customer may return, cancel, or exchange the product/service purchased from our e-commerce within 7 days, regardless of the reason, in accordance with the express provision of the Consumer Protection Code (Art. 49).
9.1.1 For an exchange or return to occur, the product must be in the condition in which it was delivered, with all accessories, manual, and packaging, including the box.
9.1.2 The product to be returned or exchanged must not show any signs of use, such as being cracked, scratched, or showing signs of falling.
9.2 If you requested an exchange of the product, the new one will be shipped to the address, and you will be notified of the shipment via email.
9.3 If you canceled and requested a refund, the refund will be processed in the same manner as the payment was made.
9.3.1 If the payment was made via credit or debit card, the amount will be credited or debited on the current or following card statement, as we will notify the card issuer.
9.3.2 If the payment was made via bank transfer or PIX, the refund will be processed within up to 30 business days, to the account provided by the customer for the refund. We will request this account via email and formalization. The refund period starts from the date of request and customer’s confirmation.
10. Deadlines and Penalties
10.1 All deadlines are calculated considering BUSINESS DAYS, starting after the date of the initial ideas meeting with the interior design professional.
FIRST VERSION OF THE PROJECT
10.2 SPOSATO is obliged to deliver services related to the EXPRESS plan within a maximum of 15 days.
10.3 SPOSATO is obliged to deliver services related to the COMPACT plan within a maximum of 15 days.
10.4 SPOSATO is obliged to deliver services related to the PREMIUM plan within a maximum of 15 days.
CHANGES AFTER THE FIRST PROJECT VERSION
10.5 SPOSATO is obliged to deliver services related to the first round of changes for the EXPRESS plan within a maximum of 7 days.
10.6 SPOSATO is obliged to deliver services related to the first round of changes for the COMPACT plan within a maximum of 7 days.
10.7 SPOSATO is obliged to deliver services related to the first round of changes for the PREMIUM plan within a maximum of 7 days.
SECOND PROJECT CHANGE – AVAILABLE ONLY FOR COMPACT AND PREMIUM PLANS
10.9 SPOSATO is obliged to deliver services related to the second round of changes for the COMPACT plan within a maximum of 7 days.
10.10 SPOSATO is obliged to deliver services related to the second round of changes for the PREMIUM plan within a maximum of 7 days.
10.11 SPOSATO is obliged to deliver services related to UPGRADES within a maximum of 7 days.
10.12 The performance of more changes, additional requests, or unavailability of the client’s schedule will alter the deadlines with additional days.
11. CONDITIONS FOR COMPLIANCE WITH THIS CONTRACT
11.1 The dimensions of appliances, objects, or other materials related or adjacent to the project in development must be defined at the project ideas meeting by the CONTRACTOR, who must provide all relevant information for those measurements.
11.2 Any omissions, mistakes, or failure to provide appliance information during the project phase, or errors in information provided by the CONTRACTOR, will not hold the CONTRACTED party responsible if the products do not fit into the pre-established spaces or damage any furniture or property.

13. Jurisdiction
13. The jurisdiction of our company’s city is elected to resolve any controversies, doubts, misunderstandings, disputes, or issues arising from the client and e-commerce relationship, even if another jurisdiction may exist, regardless of its privileged nature.
